Definitions

The following definitions apply in these Terms and Conditions

1.1 Organizer:

1.2 Contractor:

The (legal) person who for himself and / or others enters into an agreement with Organizer concerning a Training.

 

1.3 Participant:

The person participating in a training or event. This can be the person who has booked himself, the person for whose benefit and who has accepted the booking or the person who participates on the basis of the substitution.

1.4 Training:

Training means: mountain training, MRT Motor Driving Skills training.

 

Applicability

 

2.1 These conditions apply to all agreements and the realization between Organizer and contractor / participant regarding (participation in) a Training

 

 

Bookings

3.1 An agreement is concluded at the moment of acceptance of the offer by the contracting party

 

3.2 An agreement with regard to (participating in) a training can be concluded verbally, by telephone or in writing.

 

3.3 Organizer sends a confirmation of the agreement (hereinafter referred to as registration) to the contractor with these general terms and conditions attached.

 

3.4 The Enrollment states the place, date and time at which the training starts. It also states the number of participants for which the contractor concludes the agreement and any other details.

 

3.5 The person who books (also) on behalf of or for the benefit of another person is (jointly and severally) liable for all obligations arising from the agreement and guarantees that the other person knows and complies with all obligations arising from the agreement and meets the stipulations conditions.

 

 

4 Payments

 

4.1 All bookings must be paid directly through the booking system of the website.

 

4.2 If the organizer has not received the full or partial payment before the start of the training, the organizer is entitled to refuse participation in the training. In that case, the payment obligation for the contractor remains unchanged.

 

4.3 Cancellation costs must be paid within 14 days after the cancellation.

 

4.4 If a financial obligation towards the organizer is not or not timely fulfilled, the organizer is entitled to reimbursement of the statutory interest. The organizer can also claim payment of all extrajudicial collection costs equal to 15% of the amount claimed with a minimum of € 45.40.

 

 

Changes and cancellation by the organizer

 

5.1 In the event of compelling circumstances, the organizer can make changes to the agreed date, time or place of the training or cancel the training.

 

5.2 Compelling circumstances include:

- Circumstances of such a nature that the contractor's further commitment to the agreement cannot be demanded;

- Bad weather conditions (severe frost, slippery training location due to freezing, black ice, snow, heavy storm and weather warning by the KNMI / ANWB)

- Blackouts

- insufficient registrations, such at the discretion of the organizer

 

5.3 In the event of insufficient registrations - as stated in Article 5.2 - the organizer can only cancel up to 5 days before the start of the training.

 

5.4 Changes and cancellations are communicated to the contractor in writing or by telephone as soon as possible. If the contracting party has (also) booked for another, he must inform this other.

 

5.5 If the changes and cancellations are not reasonably acceptable to the contractor, the organizer will offer an alternative as far as possible and within a reasonable period of time. If it is not possible to offer an alternative or the alternative offered is not reasonably acceptable, the organizer will immediately refund the course fee already paid to the contractor. The organizer is under no circumstances liable for interest and / or compensation.

 

5.6 The provisions under 5.5 do not apply if the need for change or cancellation is attributable to the contractor and / or participant. The cancellation is then considered as the cancellation by the contractor or participant himself.

 

 

6 Cancellation by the contractor / participant

 

6.1 The contractor / participant is advised to take out travel and cancellation insurance.

 

6.2 In the event of cancellation by the contractor / participant, the following cancellation costs are due per canceling participant:

All training sessions with the exception of mountain training sessions

- From the date of booking up to and including the seventh day after the booking free of charge, unless the training starts and is taken within this period of 7 days;

- 25% of the course fee from the eighth day after booking until 30 days before the start of the training;

- From 30 days to 14 days before the start of the training 50% of the course fee;

- From 14 days to 7 days before the start of the training 75% of the course fee;

- From 7 days before and on the day of the training itself: 100% of the course fee

 

Mountain training and multi-day trips

- From the date of booking up to and including the seventh day after the booking free of charge, unless the training starts and is taken within this period of 7 days;

- From the eighth day after booking up to 60 days before the start of the training 50% of the course fee;

- From 60 days before the start of the training to 31 days before the training 75% of the course fee;

- From 31 days before the start of the training and on the day of the training itself: 100% of the course fee;

 

6.3 Failure to appear on the training course without prior cancellation is treated as cancellation on the day of the training.

The voluntarily leaving the (mountain) training by the contractor / participant, for example due to weather conditions, is equated with cancellation on the day of the training.

 

6.4 Cancellation by the contracting party / participant must at all times (in addition to any telephone or personal) be made in writing by letter or email to the organizer.

 

6.5 If the one-day or multi-day training is offered at a promotional rate or discount, cancellation in accordance with art. 6.2 used the standard course amounts as stated on the website.

 

 

Changes by the contractor / participant

 

7.1 The contractor / participant has the right to request changes to the agreement to the extent that this is practicable, at the discretion of the organizer.

 

7.2 In the event of changes at the request of the contractor / participant, the following is due per participant if the request is made:

- from the date of the booking up to and including the seventh day after the booking free of charge, unless the training starts and is taken within this period of 7 days.

- 25% of the course fee from the eighth day after booking until 30 days before the start of the training.

- from 30 days to 14 days before the start of the training 75% of the course fee;

- 100% of the course fee from 7 days before and on the day of the training itself.

 

7.3 For trainings that start within seven days after the booking date (so-called "last minute" bookings, no changes are possible.

 

 

8 Substitution

 

8.1 If a participant is unable to participate in the training, it can be replaced by another at the request of the contractor under the following conditions:

- The contractor hands the new participant the invitation / confirmation and these general terms and conditions.

- The new participant will not receive a new invitation or confirmation from the organizer

- The contractor remains fully liable towards the organizer for the payment of the course and any costs and guarantees that the new participant complies with all obligations arising from this agreement and meets the set conditions.

- The request for substitution must be submitted to the organizer in writing or by telephone no later than two working days before the training.

 

 

9 Admission requirements

 

9.1 The following conditions apply to participation in a (driving ability) training:

a. The participant:

- must be in possession of a valid and legally prescribed driving license of the category required for the vehicle that is being driven during driving skills training;

- in the case of driving proficiency training, may not have a driving license disqualification;

-May not be under the influence and may not make use of alcoholic beverages or any other substance before or during the (driving ability) training that he knows or may suspect that this has a negative effect on driving ability;

- must adhere to all instructions from the organizer, the instructors / staff;

- must adhere to the traffic regulations in force in the country concerned during driving skills training inside or outside the Netherlands;

- must behave in accordance with current standards.

b. If participation is made with a vehicle not made available by the organizer, the participant guarantees that this vehicle;

- is insured in accordance with the legal provisions and the use of the vehicle for test and training trips is not excluded in the insurance conditions (the participant must explicitly request this from the insurance company in advance);

- meets the legally prescribed safety and design requirements;

- the organizer reserves the right at all times to refuse the vehicle with which the student wishes to follow the course.

- Comments from instructors / staff of the organizer with regard to improving the driving skills of the participant must be seen as advice. The participant is never obliged to follow these comments and remarks. The participant will not be able to drive above his own or take irresponsible risks in relation to his (driving) skills.

 

9.2 If the aforementioned obligations and conditions are not met, the organizer has the right not to allow the participant to participate in the (driving ability) training or to deny him further participation or (in the case of violation 9.1b) to prohibit the vehicle referred to, without that a claim can be made for any refund of the course fee.

 

 

10 Responsibility in the event of damage or accident

 

10.1 During the driving proficiency training, the participant is at all times personally responsible as legal director for his (traffic) behavior and the consequences thereof.
